  • Full text

An allotment garden is a garden that is used for non-commercial horticultural purposes, in particular for the production of horticultural produce for personal use and for recreation. An allotment garden is located in a complex in which several individual gardens are grouped together with communal facilities, for example paths, play areas and clubhouses. Excluded from this are owner, employee and residential gardens or burial grounds.

The provisions of the German Civil Code apply to the lease of an allotment garden. These stipulate that you as the tenant can cultivate the garden and keep the profits. For this you pay an agreed rent to the landlord. Within the allotment garden site, the association statutes of the managing allotment garden organisation or the allotment garden association regulate, among other things, the rights and obligations of the members.
