    Application procedure and significance of a certificate of pre-emption rights

    The municipality has a statutory right of first refusal. This gives it the opportunity to force the buyer out of the contract and take its place in order to ensure orderly urban development in the long term.

    In the context of land and property purchase transactions, it is often necessary to apply for a certificate from the municipality in whose jurisdiction the purchase property is located as to whether a right of first refusal exists and, if so, whether it will be exercised. If the municipality does not make use of its right (as a rule), a negative certificate is issued for a fee.
