What is the legal basis for penalties and what is the cost of an offence?

The regulatory ordinance of the municipality of Rüdersdorf bei Berlin states, among other things, that parking in traffic areas is only permitted within the scope of their intended purpose. Section 3 (2) of the ordinance stipulates that the parking of cars, motor vehicles of all kinds, etc. in facilities, in particular in green areas and roadside greenery, is prohibited.

A fine of up to € 1,000.00 may be imposed for offences.

Why was such a ban issued in the first place?

The green spaces of a municipality not only serve as visual beautification, they also store water and are able to relieve the sewerage network during heavy rainfall. They also reduce air pollution and environmental noise and improve the climate.

If this area is now frequently used as a car park, the ground becomes compacted. This makes it more difficult for water to be absorbed by the green areas during heavy rainfall and there is an increased risk of flooding of traffic routes, which can severely impair road safety in the form of aquaplaning. In addition, the difficulty in absorbing water can lead to the green areas drying out. This means that the actual purpose can no longer be fulfilled. Instead, sand is suddenly washed out and large puddles form.

Often parking is also done in drainage swales or drainage ditches. Due to the aforementioned compaction, these can no longer absorb sufficient water at some point.

In order to ensure road safety and the proper drainage of rainwater, parking is therefore prohibited on the green areas of the municipality of Rüdersdorf bei Berlin.

An exception to this is the hard shoulder, provided it is adequately surfaced.
