The following statement is issued regarding the reactions in recent days to the new plantings in Hans-Schröer-Straße:
The main committee passed a resolution on the tree planting in Hans-Schröer-Straße in Rüdersdorf on 14 November 2019.
Furthermore, according to Section 9a of the Brandenburg Road Act, the road construction is the responsibility of the road construction authority, in this case the municipality of Rüdersdorf bei Berlin.
This means that all relevant tasks (construction, maintenance, preservation of road safety) are to be carried out by the road owner as official duties in the exercise of sovereign activities.
This means that all associated duties, including the replanting of street trees, must be fulfilled by the road owner. As diseased and unstable street trees must also be felled in order to fulfil the obligation to establish and maintain road safety, replacements must be planted in return. These requirements for replacement planting are issued to the municipality by the Lower Nature Conservation Authority and the recognised nature conservation associations. The municipality is also regularly obliged to provide evidence of this. The road residents have no right to demand that the road, and therefore also the roadside greenery in the road parcel, is not changed.
The maintenance of the green areas in front of the properties is regulated in the street cleaning statutes. If you have any questions or suggestions for changes, please contact your municipal representatives.
We would also like to point out that the parking and storage of motor vehicles or other objects in the roadside greenery and public green spaces is not permitted. Otherwise a special permit is required.
